Fraternity and Public Reason (Responsibility, Fraternity and Sustainability in Law / Responabilité, fraternité et développement durable en droit, Forthcoming) on SSRN. Here is the abstract:
More than anything else, it is fraternity that most consistently inspired the life and work of Charles Doherty Gonthier, who was a justice of the Supreme Court of Canada. The man was widely known as profoundly religious, while the judge proved to be a liberal with a clear sense of the limits of the state's role in the realm of morality. This brief paper, derived from a commemorative address, briefly explores the various ways of reconciling these two positions, looking at the concept of fraternity through liberal reciprocity, consensus, and public reason.
