Information is nonrivalrous, but whether it is nonexcudable or not depends on whether either law or self-help can effectively prevent copying in violation of the Copyright Act. In theory, I think that strict enforcement of criminal penalties might be sufficient to create effective exclusion. In practice, I wonder whether strict enforcement is politically feasible.
