There are some strong reactions to this ruling on http://yro.slashdot.org/article.pl?sid=04/10/02/1648254&tid=123>slashdot. A rather large number of posts are most concerned about how this affects EULA's. Perhaps contracting away your right to fair use should simply be against public policy - rather like not being able to contract away your rights to warranties of habitability on your apartment. There must be similar ethical argument in there somewhere.
