This Note argues that given congressional authorization, state statutes mandating divestments in Sudan in an effort to condone the Sudanese government's funding of the genocide are constitutional. It analyzes the balance of power between federal and state governments, as well as between the legislative and executive branch under the Supremacy Clause, the Foreign Commerce Clause, and the Foreign Affairs Power.
