With the European Court of Justice poised to determine the Constitutionality of the Flemish ban on ritual slaughter, the Court’s ultimate decision will have wide-ranging ramifications for all of Europe. The Court’s task of ultimately having to determine the proper balance between animal welfare and religious liberty involves having the clarity to see through the racist sentiments on clear display throughout Belgium, and separate clear science from pseudo-science. The Court should draw upon the ways the United States and Canada have addressed this conflict, as well as carefully analyze the protections outlined in the EU’s Charter of Fundamental Rights. Ultimately, it should strike down Belgium’s new restrictions on ritual slaughter.
