As part of the special issue on foster care and Fulton v. City of Philadelphia (2021), this essay provides a brief history of the role of race and religion in the foster care system. It critiques the case for failing to address the foster care system itself, and argues that Fulton essentially endorses a system that may make it impossible for state officials to ensure that the children will thrive in the homes they are obligated to find for them.
