This paper examines core concerns over the operation of the nation’s judiciary, principles for its functioning, some of the proposals for change, and considerations that should guide any changes going forward. It notes the special problems that some of the proposed changes would create and reasons to proceed slowly and carefully with any alterations of current rules. Those cautions are particularly aimed at proposals that are not necessary to correct any major problem and also are extreme in terms of the impositions that they might produce on—and potential distortions within—a well-functioning judiciary.
