Women around the world have taken to the streets to protest femicide—the gendered killing of women. Femicide is recognized as a violation of women’s human rights and is a crime in many domestic jurisdictions. Yet, femicide is not in the catalogue of international crimes triable at the International Criminal Court, at least in those terms. This Article argues that femicide can rise to the level of international crime as a crime against humanity or war crime. In particular, it explores the potential of conceiving of femicide under the rubric of gender persecution. It contends that, although femicide can amount to a number of existing international crimes, situating femicide in the category of gender persecution has the potential to communicate gravity while still emphasizing the gendered dimensions of violence.
